A federal appeals court has rejected the Trump administration’s effort to enforce an executive order imposing stricter mail-in voting rules ahead of the 2026 midterm elections. The 1st U.S. Circuit of Appeals upheld a lower-court injunction from June that blocked implementation of the order in 23 states.
The appeals court’s decision means the stricter mail-in voting rules will not be implemented before the upcoming midterm elections, in which control of both the House and Senate will be at stake. The ruling represents a setback for the Trump administration’s voting policy agenda.
The Department of Justice had previously indicated it could seek emergency relief from the Supreme Court if it did not prevail in the appeals court. The rejection of the administration’s bid suggests the case may proceed to the nation’s highest court for further review.
