President Trump’s administration has asked the Supreme Court to intervene in a legal dispute over an executive order that would restrict mail-in voting. A federal appeals court on Sunday upheld a lower court’s decision to block implementation of key parts of the order, and the Justice Department subsequently asked the Supreme Court on Monday to lift the block.
The executive order has faced legal challenges from 23 states and other parties who sued to prevent its implementation. Lower courts determined that the states would face potentially disruptive changes to their election procedures if the order were allowed to proceed without further legal review. The appeals court found that blocking the order was necessary while the legal process continued.
The Justice Department, through Solicitor General D. John Sauer, argued that the Supreme Court should restore the order, contending that the halt is premature. The DOJ’s position is that courts lack the authority to intervene at this stage because the U.S. Postal Service and other agencies involved in implementing the order are still in preliminary stages of action.
