Former FBI Director James Comey has filed a motion asking a federal judge in the Eastern District of North Carolina to dismiss criminal charges accusing him of threatening President Donald Trump’s life. The charges stem from an Instagram post featuring a photograph of seashells arranged to form the message “8647,” which prosecutors interpreted as a threat.
Comey’s legal team argues that the charges should be dismissed on First Amendment grounds, asserting that the seashell post does not constitute a “true threat” as defined by constitutional law. The defense argues that common sense should prevail in evaluating whether the image represents a genuine threat of violence, rather than protected political speech.
The case is being heard in federal court in North Carolina, where Comey had visited the beach when he posted the image. According to reports, Comey’s attorneys contend that his speech deserves constitutional protection and that the prosecution lacks sufficient legal basis to proceed with the criminal charges.
